Terms of Use

1. The EVR Foodie service

EVR Foodie helps people discover independent shops, farmers markets, roadside locations, street fairs, private events, permanent market venues, and scheduled stops. It also provides storefront, order, payment, delivery, subscription, and business-management tools.

Unless EVR Foodie expressly says otherwise for a specific transaction, each shop—not EVR.ai LLC, a listed market, or an event organizer—is the seller of its products and is responsible for its listings, products, food safety, taxes, order fulfillment, customer service, refunds, and legal compliance. EVR Foodie does not own, prepare, inspect, or endorse listed goods.

2. Eligibility and accounts

• You must be at least 13 to use EVR Foodie. If you are under the age of legal majority where you live, a parent or guardian must authorize your use and any purchase.
• You must be at least 18 and authorized to bind the organization to create or manage a shop, market, or team account.
• You must provide accurate information, keep credentials confidential, and promptly update information that changes.
• You are responsible for activity under your account and must notify us promptly if you suspect unauthorized access.
• We may require verification, limit features, suspend access, or close accounts to protect the service, comply with law, address nonpayment, or enforce these Terms.

3. Rules for shops

A shop is responsible for:

• accurate products, prices, inventory, allergens, descriptions, accepted payment methods, service locations, hours, delivery availability, and order status;
• all licenses, permits, insurance, food-safety practices, labeling, tax collection, recordkeeping, and consumer notices required for its business;
• preparing and fulfilling orders safely and on time, handling substitutions, responding to customers, and honoring its published refund or cancellation practices;
• confirming manual payments such as cash or peer-to-peer transfers and resolving disputes for payments processed outside an integrated provider; and
• linking a stop to a market or event only when it reasonably believes it will participate. In this service phase, EVR Foodie does not require the market operator to approve that link, and a link is not proof of organizer approval.

4. Rules for market operators

A market operator is responsible for accurate venue, schedule, organizer, policy, and public contact information. A market listing does not make EVR Foodie the operator, sponsor, landlord, permit issuer, or guarantor of the market. Shops that link themselves to a market remain independent users unless the parties separately agree otherwise. Market operators may report inaccurate participation claims to us for review.

5. Rules for shoppers and kiosk guests

Order-ahead purchases require a shopper account. A shop-operated local kiosk may permit guest orders and local payment. You agree to provide accurate order and contact details, pay the displayed amount, follow pickup or delivery instructions, and promptly raise issues with the fulfilling shop. Availability and acceptance are not guaranteed until the shop confirms or begins the order.

6. Payments, subscriptions, and refunds

Customer orders

A shop chooses which payment methods it accepts. Integrated card payments may be processed through the shop's Stripe connected account. Other methods may be handled directly by the shop and marked paid manually. Payment providers have their own terms and may require identity or business verification. The fulfilling shop controls product refunds, subject to law and the payment provider's rules.

Shop and market plans

Paid EVR Foodie plans are monthly subscriptions at the price shown at checkout. Subscriptions renew automatically until canceled. Plan changes may be prorated by Stripe. You can manage or cancel billing through the billing portal; cancellation generally takes effect at the end of the then-current paid period unless checkout states otherwise. Except where required by law or expressly stated, platform subscription fees are non-refundable.

Delivery

If integrated delivery is offered, DoorDash or another delivery provider may impose separate fees, eligibility rules, service areas, and terms. Delivery estimates are estimates, and the shop and delivery provider are responsible for the portions of fulfillment they control.

7. Listings and other content

You keep ownership of content you submit. You grant EVR.ai LLC a worldwide, nonexclusive, royalty-free license to host, copy, format, display, distribute, and use that content as needed to operate, promote, secure, and improve EVR Foodie. You represent that you have the rights needed to provide the content and that it is accurate and lawful. We may remove or limit content that violates these Terms or creates legal, safety, or service risk.

8. Prohibited conduct

You may not:

• break the law, misrepresent identity or affiliation, impersonate a shop or market, or publish fraudulent listings;
• sell prohibited, counterfeit, unsafe, recalled, or unlawfully labeled products;
• harass others, infringe rights, scrape personal information, send spam, or use the service for discriminatory or deceptive conduct;
• bypass access controls, interfere with security or availability, introduce malicious code, reverse engineer protected portions, or use automated access that burdens the service; or
• use customer or business information obtained through EVR Foodie for unrelated marketing or any purpose not reasonably expected for the transaction or service.

9. Third-party services

EVR Foodie may link to or integrate with Stripe, DoorDash, maps, payment apps, and other third-party services. We do not control their availability, decisions, fees, terms, or privacy practices. Your use of a third-party service is also governed by your agreement with that provider.

10. Disclaimers and limitation of liability

To the extent permitted by law, EVR Foodie is provided "as is" and "as available." EVR.ai LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted operation, particular sales results, the accuracy of user-submitted listings, or the quality, safety, legality, availability, or fulfillment of a shop's goods.

To the extent permitted by law, EVR.ai LLC and its members, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. Our aggregate liability arising from the service will not exceed the greater of $100 or the platform fees you paid EVR.ai LLC during the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

11. Indemnification

If you use EVR Foodie for a shop, market, or other organization, you agree to defend and indemnify EVR.ai LLC and its members, employees, and contractors from third-party claims, losses, and reasonable costs arising from your listings, products, events, operations, legal violations, misuse of customer information, or breach of these Terms, except to the extent caused by EVR.ai LLC's own unlawful conduct.

12. Changes, termination, and contact

We may change the service or these Terms. We will post an updated effective date and provide additional notice when required. Material changes apply prospectively. You may stop using the service at any time, but payment, ownership, limitation, indemnity, and other provisions that by their nature should survive will remain in effect.
